The Breathitt County Grand Jury issued an indictment on Tuesday against a sixty-seven-year-old man accused of sexual abuse of a minor.

Jerry Adams, 67, of Redmond Drive off Morris Fork Road, was indicted on April 7 on one count of Sexual Abuse, 1st Degree, Victim under the age of 12.

According to court documents, the Grand Jury found probable cause to charge the man based on an investigation and the testimony of Kentucky State Police Trooper Kevin Day.

Judge Lisa H. Whisman signed an active arrest warrant for Adams on Tuesday.

Whisman set his bail at $10,000 cash and ordered that he have no contact with the victim, that he not use drugs or alcohol, a firearm or weapon, and commit no new violations.

According to the Kentucky Revised Statutes, a person is guilty of Sexual Abuse in the First Degree when force is used, an individual has sexual contact with someone who cannot give consent, when the alleged perpetrator is more than 21 years older than the victim, or if sexual contact occurs while a person has a position of authority or trust over the victim.

Under Kentucky law, the alleged crime is a Class D felony unless the victim is under 12 years old, in which case it is a Class C felony, punishable by 5 to 10 years in state prison.
